These Terms of Use (hereinafter referred to as "these Terms") set forth the conditions for using the website operated by Pivot Company, Limited (hereinafter referred to as "the Company") (hereinafter referred to as "the Site"). By using the Site, users (hereinafter referred to as "Users") are deemed to have agreed to these Terms.

1. Scope

These Terms apply to all matters relating to the use of the Site between Users and the Company. Any provisions posted separately on the Site shall constitute a part of these Terms.

2. Purpose of the Site

The Site is operated for the purpose of introducing the Company's business, services, and related information, providing exchange rates and other reference information, and receiving inquiries from clients and prospective clients.

3. Intellectual Property Rights

All copyrights, trademarks, and other intellectual property rights in the text, images, logos, designs, source code, and any other content on the Site belong to the Company or the rightful third parties. Users may not reproduce, republish, distribute, modify, or otherwise use such content without the prior written consent of the Company or the rights holder.

4. Prohibited Acts

Users shall not engage in any of the following acts when using the Site:

  • Acts that violate laws, regulations, or public order and morals
  • Acts related to criminal activity
  • Acts that infringe the intellectual property rights, portrait rights, privacy rights, reputation, or other rights or interests of the Company, other Users, or third parties

You are generally free to link to the Site. However, we do not permit links from sites that are illegal or contrary to public order and morals, links that may damage the reputation of the Company, or links that alter the display of the Site, such as by framing.

The Company makes every effort to ensure the accuracy, completeness, usefulness, and timeliness of the information posted on the Site, but does not guarantee any of these. The Company is not liable for any damages arising from the use of information on the Site by Users.

The Site may contain links to third-party websites that are not operated by the Company. The Company is not responsible for the content of such linked websites or for any damages arising from the use of such linked websites by Users.

7. Exchange Rate Data

Exchange rates displayed on the Site ("Exchange Rate Data") are provided for general reference only, based on information published by the Board of Governors of the Federal Reserve System (the "Board"). Cross rates not published by the Board are calculated by the Company from US dollar rates. Exchange Rate Data is several days old, can be more than a week old, and does not represent rates at which any transaction can be made. The Company does not guarantee the accuracy, completeness, or timeliness of Exchange Rate Data.

Exchange Rate Data and other content on the Site are not investment advice and are not a recommendation or solicitation to buy or sell any currency, financial instrument, or other asset. Users shall make any investment decision at their own judgment and responsibility.

The Board is not affiliated with the Company and does not endorse the Company or the Site.

8. Modification and Suspension of Services

The Company may, without prior notice to Users, modify the content, structure, URL, or any other aspect of the Site, or temporarily suspend or terminate the provision of the Site. The Company is not liable for any damages caused to Users or third parties by such actions.

9. Handling of Personal Information

The handling of personal information acquired through the use of the Site is governed by our separate Privacy Policy.

10. Governing Law and Jurisdiction

These Terms shall be interpreted and applied in accordance with the laws of Japan. Any disputes arising between the Company and Users in connection with the Site or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court for the first instance.

11. Amendments to These Terms

The Company may amend these Terms without prior notice to Users when it deems necessary. The amended Terms take effect from the time they are posted on the Site, and use of the Site after the amendment shall be deemed acceptance of the amended Terms.
